CNR presentation :

The Comité National Routier (hereinafter the «CNR») is a professional committee for economic development whose main remit is to observe and monitor the economic aspects of the road freight transport market and the road passenger transport market (excluding urban and suburban passenger transport), in particular through the analysis of costs and the conduct and dissemination of research and studies relating to these markets.

The CNR makes this website available to Users; it can be accessed at the following address: https://www.cnr.fr, the terms of access to and use of which are governed by these General Terms and Conditions of Use.

Definitions :

“Terms of Service or TOS”. means the provisions herein governing access to and use of the Site and its Services.

“Data ” refers to all the information communicated by the User during his/her visit, as well as any element collected automatically by the Site during his/her visit, and used to improve the Site.

« Site » refers to the CNR website located at the URL «www.cnr.fr», including all pages of said website.

« Services » refers to the services offered by the CNR on its Website and defined in Article 2.

The Services comprise both free and paid services, it being understood that the latter are subject to the general terms and conditions of sale (hereinafter «GTC») which can be accessed via the following link: GTCS

« User »means any legal or natural person visiting the website «www.cnr.fr», as well as all the pages of that website.". 

Article 1 - Purpose

1.1. The purpose of these General Terms and Conditions of Use is to set out the terms and conditions governing the use of the Website and the Services available on the Website which the CNR makes available to Users, as well as the relationship between the CNR and Users.

Browsing on the Site automatically entails the User's full and unreserved acceptance of these GTCU.

The applicable GTCU are those in force at the time of each navigation of the User to the Site. Consequently, the User is invited to read the Terms and Conditions of Use each time he visits the Site.

These GTCUs can be modified at any time by the CNR as necessary. In this case, the User acknowledges that his use of the Site after modification of the GTCUs will automatically imply acceptance of the GTCUs thus modified.

1.2. If a User uses the Site on behalf of an entity (e.g., association, company, foundation), he guarantees that he holds all the necessary authorizations to accept the GTCU on behalf of the entity for which he uses the Site. In this case, his access to the Site will also entail unreserved acceptance of the GTCU by the entity in question.

Article 2 - Description of the site

The Site provides access to various Services made available by CNR.

In particular, it provides access to the following Services:

  • The provision of indicators and statistics;
  • Publications on a variety of topics;
  • The CNR newsletter;
  • Tools for carrying out simulations (including tools for calculating price indexation and a cost simulator for road transport vehicles);

The Website also offers paid Services, the specific features and terms of which are set out in the Terms and Conditions, which can be accessed via the following link: GTCS . 

The CNR reserves the right to offer all or part of the paid Services detailed in the Terms and Conditions free of charge to certain Users who have been provided with a code for this purpose.

In this case, the User must create a User account on the Website, as set out in the Terms and Conditions.

The provision of free access is subject to a time limit and may be terminated unilaterally by the CNR at any time.

Article 3 - Subscription to the newsletter

The Site allows Users to subscribe to the CNR newsletter free of charge by providing their e-mail address.

By subscribing to the newsletter, the User receives a confirmation e-mail containing a hypertext link to the CNR website.

The User may request cancellation of his subscription at any time. E-mails sent by the CNR due to a subscription to the newsletter contain a link entitled "unsubscribe" allowing the User to unsubscribe. It is also possible for the User to formulate the unsubscription request by e-mail at the following address: cnr@cnr.fr.

Article 4 - Personal data

The CNR is required to collect and process the User's personal data.

The CNR complies with the applicable legislation regarding the protection of Users' personal data and with Law No. 78-17 of January 6, 1978 relating to computers, files and freedoms, as amended by Law No. 2018-493 of June 20, 2018, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of such Data (GDPR).

Article 5 - Declarations and Obligations of the User

By accessing the Site, the User undertakes to comply with the laws and regulations in force.

The User acknowledges :

– To be familiar with the principles underpinning the operation of the Internet and electronic communications networks, and to accept their characteristics and limitations;

– Be aware that the CNR has no control over the nature and characteristics of the data available on the Internet and that, consequently, the CNR cannot accept any liability arising directly or indirectly from such data;

– Be aware that data transmitted over the Internet cannot be completely protected against potential misuse and that, as a result, any communication is made at the User’s own risk. The CNR does, however, implement appropriate technical measures designed to protect data against accidental loss or unauthorised access or disclosure.

However, the Internet remains an open system and the CNR cannot guarantee that unauthorised third parties will not be able to circumvent these measures and gain access to the data.

– Be aware that viruses may be introduced by third parties via the Internet and, consequently, acknowledge that it is their responsibility to take all appropriate measures to ensure the protection of data stored on their computer equipment; ;

By using the Website, the User assumes the risks relating to the completeness, accuracy or timeliness of the information on the Website that they use, at their own risk and under their own responsibility.

The User shall indemnify the CNR and its partners against any claim or action by any third party, and any resulting financial consequences, arising from the User’s use of the Website or from the User’s breach of the Terms of Use, the Terms and Conditions of Sale, the Privacy Policy or the applicable regulatory provisions.

As such, it undertakes not to use any software, applications, or technical means enabling it to interfere with the normal operation of the Site and Services as provided for in the Site's TOS and GTCS.

The User must ensure that they comply with the operation of the Website and the technical measures used to ensure the security of the Website and access to the Website.

Any violation of these TOS may be punished both civilly and criminally.

Article 6 - Access to the site :

The CNR strives to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure, as defined by Article 1218 of the French Civil Code and by French case law, and also subject to possible breakdowns and maintenance or upgrading of the Site, without these interruptions giving rise to a right to compensation for the User.

The CNR may not be held liable when access to the Site is interrupted or impeded due to the quality of the Internet and electronic communication networks.

In addition, the User accepts that the CNR may have to interrupt the Site and all or part of its Services at any time and without notice.

The CNR shall not be held responsible in the event of impossibility of access to the Site and/or use of the Services, the Users waiving any claim or action in this respect.

In addition, Users undertake to inform the CNR of any behaviour that may result in the interruption of access to the Site.

Article 7 – Hyperlinks :

7.1 Links from the Website to third-party websites: 

The Site may propose to the User to use hypertext links leading to other websites. Linking the Site to these sites is deemed to provide additional qualified information. Under no circumstances can the CNR be held responsible for the content of these sites that it does not publish, and which may evolve, the User acknowledging that these sites and services of third parties or partners are completely independent of the CNR. The proposed redirection to a third party site is not a recommendation and the CNR is in no way responsible for the editorial content proposed in the sites concerned, the consultation of these sites being under the sole responsibility of the User.

7.2 Links from third-party websites to the CNR website:

By creating one or more hyperlinks to the Website, the User undertakes not to make any changes to the content and information on the Website or to alter its Services (e.g. additions, deletions, edits, substitutions, extracts, advertisements, etc.).
Regardless of the type of hypertext link pointing to the Site, the User is not authorized to set up a systematic referencing mechanism of all or part of the information and content present on the Site for any reason whatsoever and in particular in order to offer a service to the public, in particular for commercial purposes, without the prior written authorization of the CNR.

Finally, third-party websites linking to the CNR website must under no circumstances publish unlawful content (e.g. glorification of crimes against humanity, child pornography, incitement to racial hatred or violence, or content that undermines the dignity of a person or group of people), nor may they damage the CNR’s reputation.

Article 8– Intellectual property :

The Site is an indissociable whole. The information contained therein is reserved for exclusively personal use and may not be reproduced, in whole or in part, or communicated to third parties for any reason whatsoever.

The CNR is the exclusive owner of all intellectual property rights relating to the content (such as texts, graphic charter, visuals, sounds, images, photographs, domain name, logo(s)) appearing on the pages of the Site or has been granted licenses as such.

Likewise, it is the exclusive owner of the structure of the Site.

Any reproduction, representation, distribution or use of any kind, in whole or in part, of the content of this site, in any medium or by any process whatsoever, for any purpose other than personal, is prohibited without the prior consent of the CNR.

Failure to comply with this prohibition constitutes, in particular, an infringement within the meaning of Articles L.335-2 et seq. of the Intellectual Property Code, which may result in civil and criminal liability for the infringer.

Article 9 – Limitation of liability :

The information contained on the Website is provided for informational purposes only, and the Services and the Website are provided ‘as is’. As such, CNR cannot be held liable and makes no warranties, express or implied, and assumes no responsibility for the use of this information, the Services or the Website.

The User acknowledges that the CNR cannot be held liable for any direct or indirect damage, including material damage, immaterial damage, loss of data or programmes, or financial loss resulting from access to, inability to access, or use of the Website or any websites linked to it, or from the interruption, suspension, modification, or discontinuation of the Website or any of its elements.

Furthermore, CNR shall not be held liable in the event of inaccessibility of the Site, particularly during maintenance or in the event of force majeure.

In addition, CNR does not guarantee the completeness, timeliness or relevance of the information provided on the Site.

The User is advised that the CNR will provide any information enabling or facilitating the identification of any person guilty of an offence against the law or an infringement of the rights of the CNR or a third party at the request of an authority or court, such as IP addresses and connection times.

In the event that the CNR is held liable in a court of law due to a User's failure to comply with its obligations, the CNR may call upon the User as guarantor.

The User acknowledges that they are solely responsible for their use of the Website, the information and the Services accessible via the Website.

Article 10 – Applicable law :

Both this Website and its Services, as well as the terms and conditions governing their use, are governed by French law, regardless of the place of use.

If any provision of these GCU is found by any authority or jurisdiction to be invalid or unenforceable, it shall be deemed unwritten and shall not invalidate the remaining provisions, which shall remain in full force and effect.

Any dispute resulting from the use of this Site and the paid Services it offers or from the distribution of the information it contains will be under the exclusive jurisdiction of the Courts of Paris applying French Law.
